1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you ("you" or "user") and Modem Boost ("we," "us," or "our") regarding your access to and use of modemboost.com (the "Site") and any related services. By accessing or using the Site or by placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately stop using the Site.

2. Intellectual Property Rights

Unless otherwise indicated, the Site and its contents — including but not limited to design, layout, source code, product copy, photographs, illustrations, graphics, logos, trademarks, audio, video, and the "Modem Boost" brand — are owned by or licensed to Modem Boost and are protected by United States copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit, distribute, resell, scrape, mirror, or commercially exploit any part of the Site or its content without our prior written permission. Personal, non-commercial viewing is permitted.

3. User Representations

By using the Site, you represent and warrant that: (a) you are at least 18 years old, or you are using the Site under the supervision of a parent or legal guardian who agrees to these Terms; (b) you have the legal capacity to enter into these Terms; (c) you will not access the Site through automated or non-human means except where expressly permitted; (d) you will not use the Site for any illegal or unauthorized purpose; (e) your use of the Site will not violate any applicable law or regulation; and (f) you will provide accurate, current, and complete information for any order or account you create.

4. Products

Modem Boost makes reasonable efforts to display product colors, specifications, packaging, and details as accurately as possible. However, actual product appearance may vary depending on your screen settings, lighting, and device. Products are subject to availability, and we reserve the right to discontinue or modify products at any time without notice. Prices are subject to change. Product descriptions and marketing copy should not be interpreted as a guarantee of internet speed or specific network performance; real-world performance depends on your router, ISP plan, home layout, wall materials, signal interference, and other environmental factors.

5. Purchases and Payment

We accept the following payment methods: Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, Klarna, and other secure checkout methods we may make available from time to time. All payments are processed in US Dollars (USD).

• You agree to provide accurate, current, and complete billing, shipping, and contact information for all purchases.
• You authorize us (or our payment processors) to charge your selected payment method for the total amount of your order.
• We may refuse or cancel any order at our sole discretion, including orders we suspect of fraud, reseller activity, incorrect pricing, abuse, or violation of these Terms.
• Sales tax may be collected where required by law.
• All payment data is handled through secure third-party processors. Modem Boost does not store sensitive cardholder data on its servers.

6. Return Policy

We offer a 30-day return window from the date of delivery. Items must be returned in their original packaging and in the same condition you received them. Refunds are processed to your original payment method within 3 business days after approval. Bank posting times may take an additional 5–10 business days. Customers are responsible for return shipping costs unless the item arrived damaged or defective. See our full Return & Refund Policy.

7. Shipping Policy

We offer free tracked shipping across the United States. Handling time is 0–1 business day. Transit time is 4–6 business days. Total estimated delivery is 4–7 business days. Orders ship to physical US addresses only — we do not ship to PO Boxes. See our full Shipping Policy.

8. Prohibited Activities

You agree not to engage in any of the following:

• Scraping, harvesting, or collecting data from the Site without our written permission.
• Attempting to hack, compromise, or test the security of the Site or its systems.
• Uploading or transmitting viruses, malware, or other harmful code.
• Committing or attempting to commit fraud, including payment fraud or chargeback abuse.
• Harassing, threatening, or abusing our staff or other customers.
• Using bots, scrapers, or automated tools to interact with the Site, except as expressly permitted.
• Copying, reverse engineering, or reusing site code.
• Impersonating any person or entity.
• Submitting false, inaccurate, or misleading information.
• Attempting unauthorized access to any portion of the Site or related systems.
• Using the Site for any unlawful activity.
• Interfering with checkout, payment processing, or security features.
• Reselling or commercially exploiting Site content without permission.

9. User Generated Contributions

The Site may allow you to submit reviews, comments, ratings, photos, feedback, or support messages ("Contributions"). All Contributions must be truthful, lawful, non-infringing, respectful, and non-misleading. You are solely responsible for your Contributions.

10. Contribution License

By submitting Contributions, you grant Modem Boost a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, copy, reproduce, modify, publish, display, distribute, and create derivative works of your Contributions for purposes related to operating, marketing, and improving the Site and our products. You retain ownership of your Contributions.

11. Guidelines for Reviews

Reviews must be based on real, first-hand experience with our products. Reviews may not contain: hate speech; threats or harassment; private or confidential information; illegal claims; false or misleading statements; spam; competitor sabotage; or any content that violates third-party rights. Modem Boost may moderate, edit, refuse, or remove reviews at its discretion.

12. Submissions

Any feedback, ideas, suggestions, comments, or product improvement requests you submit to us are non-confidential and become our property. We may use them without compensation, credit, or notice to you.

13. Third-Party Links and Advertisers

The Site may include links to third-party websites, services, payment providers, shipping carriers, tracking tools, analytics tools, or integrations. Modem Boost is not responsible for the content, policies, or practices of any third-party sites or services and accessing them is at your own risk.

14. Site Management

We reserve the right (but are not obligated) to monitor the Site for violations of these Terms; take legal action against anyone who violates these Terms; refuse, restrict, or terminate access to the Site; remove content; and otherwise manage the Site to protect our rights and the rights and safety of users.

15. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Copyright Infringements

We respect intellectual property rights. If you believe any content on the Site infringes your copyright, please send a detailed notice to support@modemboost.com identifying the allegedly infringing content, your contact information, and a statement made in good faith that the use is not authorized by the copyright owner.

17. Term and Termination

These Terms remain in full effect while you use the Site. We may, in our sole discretion and without notice or liability, deny access to the Site, suspend or terminate your account, or block any IP address for any reason, including for violations of these Terms, fraud, chargeback abuse, or unlawful activity.

18. Modifications and Interruptions

We reserve the right to update or modify the Site, product information, pricing, or these Terms at any time without prior notice. We may also experience downtime due to maintenance, technical issues, or other reasons. We do not guarantee uninterrupted access and are not liable for any losses resulting from interruptions.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles.

20. Dispute Resolution

Informal Negotiation. Before initiating any formal dispute, the parties agree to attempt to resolve the dispute informally for at least thirty (30) days by contacting support@modemboost.com.

Binding Arbitration. If informal negotiations fail, unresolved disputes may be resolved through binding arbitration where permitted by law, on an individual (non-class) basis. The arbitration shall be administered in Kentucky, USA. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction. Consumers may still have rights under applicable state or federal law that cannot be waived.

21. Corrections

The Site may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, or other information. We reserve the right to correct any errors and to update or change information at any time without prior notice (including after you have submitted an order).

22. Disclaimer

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODEM BOOST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WiFi performance depends on many conditions, including ISP speed, router model, device compatibility, home construction, signal interference, and placement; we make no representation or warranty regarding specific network speeds.

23. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODEM BOOST AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID TO MODEM BOOST FOR THE PRODUCT GIVING RISE TO THE CLAIM, WHERE ALLOWED BY LAW.

24. Indemnification

You agree to defend, indemnify, and hold harmless Modem Boost and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any misuse of our products.

25. User Data

Modem Boost stores certain user and order data to operate the Site, fulfill orders, provide support, and comply with legal obligations. You are responsible for ensuring the information you submit is accurate and up to date.

26. Electronic Communications, Transactions, and Signatures

Visiting the Site, sending emails, submitting forms, and completing online transactions constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

27. California Users and Residents

If any complaint with us is not satisfactorily resolved, California residents can contact support@modemboost.com regarding the complaint. Under California Civil Code Section 1789.3, California users are entitled to certain consumer rights notices, including the right to file complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. California residents also have privacy rights as described in our Privacy Policy.

28. Miscellaneous

• Entire Agreement. These Terms (along with the policies referenced) are the entire agreement between you and Modem Boost.
• No Waiver. Our failure to enforce any right or provision will not be considered a waiver.
• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• Assignment. You may not assign your rights under these Terms without our consent. We may assign ours.
• Force Majeure. We are not liable for failures or delays caused by events beyond our reasonable control.
• No Partnership. Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship.
• Headings. Section headings are for convenience only and have no legal effect.
